I never said it wasn't a severe incident. Sure, this still warrants INES Level 5, but it doesn't imply that the primary fission reaction has restarted or is ongoing, which is what 'critical' means when you're talking about nuclear reactors. In this case, the release of decay products from the molten core material have been carried in the cooling water to a point outside the containment building in significant amounts. This is actually one of the known compromises of using BWRs.
